In the case, the passengers’ representative had applied for flight compensation from Brussels Airlines for a delayed flight on July 27, 2019.<\/span><\/p>\n The request for payment was sent to Brussels Airlines on August 13, 2019 via email, and Brussels Airlines then asked the representative to submit the request via the airline’s website. <\/span><\/p>\n The representative refused to do so by e-mail shortly afterwards, stating that a summons would be filed if the amount was not paid within 10 days. <\/span><\/p>\n However, it was not until June 27, 2022 that a summons was filed against Brussels Airlines, and this was too late, according to the Copenhagen City Court. In Denmark, claims are time-barred after 3 years, but the claim can also be forfeited before due to so-called “passivity”.<\/span><\/p>\n Passivity exists in situations where one party has rightly assumed that the other party (for example) will not demand payment.<\/span><\/p>\n The case then went to the High Court, which reversed the verdict and ruled that the representative <\/span> had<\/span>not<\/i><\/b> demonstrated forfeitable passivity by waiting 2 years and 11 months to bring the case against Brussels Airlines to court.<\/span><\/p>\n If you experienced a flight delay or cancellation in the summer of 2022, it’s not too late to claim your right to flight compensation.
