How long can you complain about flight delays?
Didn’t you just apply for flight compensation? – You may still have time! The Eastern High Court has recently ruled in a case against Brussels Airlines regarding flight compensation.
In the case, the passengers’ representative had applied for flight compensation from Brussels Airlines for a delayed flight on July 27, 2019.
The request for payment was sent to Brussels Airlines on August 13, 2019 via email, and Brussels Airlines then asked the representative to submit the request via the airline’s website.
The representative refused to do so by e-mail shortly afterwards, stating that a summons would be filed if the amount was not paid within 10 days.
However, it was not until June 27, 2022 that a summons was filed against Brussels Airlines, and this was too late, according to the Copenhagen City Court. In Denmark, claims are time-barred after 3 years, but the claim can also be forfeited before due to so-called “passivity”.
Passivity exists in situations where one party has rightly assumed that the other party (for example) will not demand payment.
The case then went to the High Court, which reversed the verdict and ruled that the representative hadnot demonstrated forfeitable passivity by waiting 2 years and 11 months to bring the case against Brussels Airlines to court.
