Compensation from Emirates
Many passengers believe that they are always entitled to flight compensation if they experience a long flight delay with Emirates, for example, returning from a vacation in Dubai.
Unfortunately, you’re not always entitled to flight delay compensation.
The rules on flight delay compensation are set out in Regulation (EC) No 261/2004 of the European Parliament and of the Council of 11 February 2004 establishing common rules on compensation and assistance to air passengers in the event of denied boarding and of cancellation or long delay of flights.
You are always protected by the rules if you are traveling with an airline based in Europe (e.g. SAS, Lufthansa and Air France-KLM). Here your rights in case of flight delays are clear.
However, if you are traveling with an airline based outside of Europe – such as Emirates and Etihad Airways (based in Dubai) – you are only protected by the rules of the Air Regulation on your outbound flight from Denmark (or another European country).
In other words:
A four-hour flight delay on a trip from Copenhagen to Dubai with Emirates entitles you to flight compensation of approximately DKK 4,500.
A 4-hour flight delay on a flight from Dubai to Copenhagen with Emirates does NOT entitle you to flight compensation of any kind.
However, if you fly with SAS (or another European airline), you are entitled to flight compensation in the event of a delay, regardless of whether the flight delay takes place in Copenhagen or Dubai.
