When can I claim flight compensation from KLM?
If KLM has canceled your flight, you may be entitled to flight compensation.
The rules on flight compensation are very clear.
It is only if there are “extraordinary circumstances” that KLM may be able to avoid the compensation obligation.
However, in order to avoid the obligation to compensate, KLM must also be able to “demonstrate that there were no other flights operated by KLM or any other air carrier that could have transported the passengers to their destination with a shorter delay, or that the implementation of such re-routing would be unduly burdensome for KLM at that time.”
This is stated in a judgment we have won in the Western High Court on November 12, 2021.
If your flight has been canceled due to weather conditions, whether you are entitled to flight compensation depends on several factors, such as the following:
How “bad” was the storm and can it be proven (by the airline) that air traffic in general was affected?
When did the airline become aware of the storm (and could start adapting to it)?
How long was your delay?
Can KLM prove that there were no other aircraft – either its own or those of other airlines – that could have transported you to your final destination with a shorter delay?
